Product liability claim made against convenience store

Consumers in California expect a level of quality in the products they purchase. They also expect the products will perform as promised. When food is involved, it is assumed that the item is safe and suitable for consumption. However, a Sacramento woman is gravely ill after ingesting food she purchased as a snack. The 33-year-old woman had stopped at a convenience store after work for a snack. She purchased chips and dispensed nacho cheese sauce on them. Shortly after eating them, she began feeling fatigued. By the next day, the woman was experiencing double vision and was unsteady as she walked.

She was initially sent home, but was rushed back to the hospital the following day when she had difficulty speaking and breathing. According to hospital records, she was admitted to the intensive care unit and has been put on a ventilator. The prognosis for the woman is uncertain at this time.

According to the Sacramento County Health and Human Services Department, the woman is one of five people who contracted botulism from the cheese sauce purchased at the store. The woman's family has filed a lawsuit against the business for negligence, strict product liability and breach of implied warranty. The store has been prohibited from selling prepared food by the health department.
